Agreement to Terms

By downloading, installing, or using VibeShift ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and Jyaasa Inc. ("we," "us," or "our"), the developer of VibeShift.

Description of Service

VibeShift is a macOS utility application (requires macOS 14 Sonoma or later) that allows users to create, save, and switch between customized desktop environments ("Contexts"). On a context switch, the App can modify or trigger:

• Desktop wallpaper (per display)
• Dock configuration and pinned applications
• Desktop file visibility
• Launching of selected applications
• Quitting of selected applications (with optional confirmation)
• Activation via global keyboard shortcuts
• Activation via Siri and the Shortcuts app (App Intents)
• Automation based on time of day, Wi-Fi network, or macOS Focus Mode

License Grant

Free Tier

We grant you a free, non-exclusive, non-transferable, revocable license to use the free version of VibeShift for personal or commercial purposes, subject to these Terms.

Pro Tier

Upon purchasing a valid license, we grant you a non-exclusive, non-transferable license to use VibeShift Pro on the number of devices specified in your license agreement (typically up to 3 personal devices per license).

Device limits are enforced by our license server (LemonSqueezy): each activation registers an anonymous per-device instance, and activation requests beyond your limit are refused by the server. Deactivating the license in the App frees that device's seat.

Restrictions

You may not:

• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works of the App
• Distribute, sell, lease, or sublicense the App or your license key
• Use the App for any unlawful purpose
• Share your Pro license key publicly or with unauthorized users
• Circumvent any license validation or copy protection mechanisms

Purchases and Payments

Pricing

VibeShift Pro is available as a one-time purchase. Prices are displayed in the App or on our website and may change without notice. Price changes do not affect existing license holders.

Payment Processing

All payments are processed by LemonSqueezy. By making a purchase, you also agree to LemonSqueezy's terms of service.

License Keys

Upon purchase, you will receive a license key via email. You are responsible for keeping your license key secure. Lost license keys can be recovered by contacting support with proof of purchase.

Refunds

We offer a 14-day money-back guarantee. If you are not satisfied with VibeShift Pro, contact us within 14 days of purchase for a full refund. After 14 days, refunds are granted at our discretion.

Intellectual Property

Ownership

VibeShift, including its code, design, graphics, and documentation, is owned by Jyaasa Inc. and protected by copyright and other intellectual property laws.

Trademarks

"VibeShift," "ContextShift," the VibeShift logo, and related marks are trademarks of Jyaasa Inc. You may not use these marks without our prior written permission.

Your Content

You retain ownership of any content you create or configure within the App (such as context profiles, wallpaper selections, app lists, and automation rules). We claim no ownership over your configurations or files.

User Responsibilities

System Modifications

VibeShift modifies system settings and other applications' lifecycle to function. By using the App, you acknowledge that:

• The App writes to system preference files (e.g., com.apple.dock.plist)
• The App moves files on your desktop to manage visibility (files are relocated to ~/Desktop/.vibeshift_storage/, never deleted; the Desktop tab includes "Restore All Hidden Files" and "Reveal Storage" actions, and deleting a context restores its hidden files)
• The App may restart system processes (e.g., Dock) to apply changes
• The App can launch applications in the background when you switch contexts
• The App can quit applications when you switch contexts; for any app where you have enabled "Ask first," the App will prompt you for confirmation before quitting
• The App registers system-wide keyboard shortcuts (⌘⌃1–0), assigned per context and stable for that context's lifetime
• The App can register itself as a login item when "Start at login" is enabled (manageable in System Settings → General → Login Items)

You can disable the per-context behaviors — wallpaper, Dock, desktop files, launching and quitting apps, and automations — at any time by editing the affected context. Global keyboard shortcuts are assigned automatically to your first ten contexts and remain registered while the App is running.

Backups

We recommend maintaining regular backups of your system. While VibeShift is designed to be safe and non-destructive, you are responsible for backing up important data.

Permissions

Certain features require system permissions:

You may revoke these permissions at any time in System Settings, though some features may not function without them.

Disclaimers

"As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT

No Guarantee

We do not guarantee that:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, secure, or error-free
• Results obtained from the App will be accurate or reliable
• Any errors in the App will be corrected

System Compatibility

We strive to maintain compatibility with current macOS versions. However, Apple may change system APIs that affect the App's functionality. We are not responsible for issues arising from:

• macOS updates that break compatibility
• Third-party software conflicts
• Hardware-specific issues

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

No Consequential Damages

IN NO EVENT SHALL JYAASA INC. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits or revenue
• Loss of data or files
• Loss of use or functionality
• Business interruption

Liability Cap

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.

Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Jyaasa Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

Termination

By You

You may stop using the App at any time by uninstalling it from your device.

By Us

We may terminate or suspend your license immediately, without notice, if you:

• Violate these Terms
• Engage in fraudulent activity
• Share or distribute license keys without authorization

Effect of Termination

Upon termination:

• Your license to use the App ceases
• You must uninstall the App from all devices
• Provisions that by their nature should survive (such as limitations of liability) will remain in effect

Updates and Changes

App Updates

We may release updates to the App that add features, fix bugs, or address security issues. Updates may be installed automatically through the Sparkle framework.

Terms Updates

We may modify these Terms at any time. We will notify you of material changes by:

• Posting a notice in the App
• Updating the "Last Updated" date

Your continued use of the App after changes constitutes acceptance of the modified Terms.

Governing Law and Disputes

Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

1. Informal Negotiation: Contact us first at legal@jyaasainc.com to attempt resolution.
2. Binding Arbitration: If informal resolution fails, disputes shall be settled by binding arbitration in accordance with the Arbitration Act of Ontario.

Class Action Waiver

You agree to resolve disputes with us on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jyaasa Inc. regarding the App.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms or your license without our prior written consent. We may assign our rights and obligations without restriction.
